Advertiser acknowledges that the sole obligation of AerospaceMall is to display linked banner advertisements from advertiser which conforms to the specifications of their signed contract. In this regard, Advertiser agrees that AerospaceMall has the right to market, display, perform, transmit and promote the linked banner advertisement and users of AerospaceMall have the right to access and use the advertisements and any content and/or services directly linked to the advertisements.
Under no circumstances shall AerospaceMall be liable to the advertiser for indirect, incidental, consequential, special or exemplary damages (even if such damages are foreseeable, and whether or not AerospaceMall has been advised of the possibility of such damages) arising from any aspect of the advertising relationship provided for herein. AerospaceMall shall in no event be liable to advertisers for more than the total amount paid to AerospaceMall hereunder. AerospaceMall makes no representations, and hereby expressly disclaims all warranties, express or implied, regarding AerospaceMall’s services or any portion thereof, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance. Without limiting the generality of the foregoing, AerospaceMall specifically disclaims any warranty regarding the number of persons who will access the advertisements.
Advertiser is solely responsible for any legal liability arising out of or relating to the advertisement and/ or the advertisers web content. AerospaceMall reserves the right to reject any advertising that is not consistent with AerospaceMall’s standards. |
